What American experience of blocking the launch of a new brand of hemp wine on the market may be of interest to producers in Ukraine

Kaelan Castetter, director general of the New York Castetter Sustainability Group, claims that he is not abandoning plans for the sale of wine with the addition of hemp terpenes even after U.S. federal regulators blocked his attempt to launch a new brand of the alcohol product. In particular, in 2019, the initiative of Sovereign Vines (a subsidiary of the Castetter Sustainability Group) to introduce semisweet white wine and red cabernet Sauvignon brands to the American market with hemp terpenes added to the recipe (bring a “unique, earthy tone” to the product) was blocked by the American Bureau of taxes and trade in alcohol and tobacco (Tax and Trade Bureau, TTB). The absurdity of the situation is that the regional branch of the above New York State regulator supported the idea of ​​using hemp terpenes in a product manufactured by the company, and federal regulator officials blocked the market entry of this product and ordered a check, as a result of which the company incurs significant financial sanctions.

Kelan Castetter’s father developed a recipe for wine filled with hemp terpenes back in 1997 on the eve of the boom of commercial products made from plants. Twenty years ago, TTB officials banned the use of hemp plant terpenes in wine recipes. Given the rapid changes in the regulatory framework in the United States regarding industrial hemp breeding, Kelan Castetter considered it possible once again to try to realize his father's idea, given the support of the regional representative office of TTB, the governor of the state, as well as representatives of the state in the US Senate. 

Nevertheless, TTB federal officials made the aforementioned dubious decision, and immediately afterwards came with a check on the company's production facilities. According to the results of the inspection, about 2,000 gallons of wine containing hemp terpenes are ordered to be destroyed, and the distillery's activity is blocked. Based on the decision of TTB at the end of 2019, the Food and Drug Administration has ordered the ban on the use of hemp terpenes in the formulations of any wine. The official position of US government agencies is that, in accordance with the current federal policy, terpenes extracted from hemp flowers cannot be legally added to consumed products.
