Problems CBD products in the USA

- what quality CBD products are sold on the territory of Ukraine, if there is no control whatsoever in our country for such products sold on the Internet;

- why the public of our country does not raise the question of the need to use absolutely socially safe leaves and inflorescences of technical hemp of a therapeutic orientation with a significant healing effect for industrial purposes;

- where will the “Chinese / global CBD consumer goods” pour in when the criteria for the quality of such products are regulated at the level of the regulatory framework in economically developed countries.

A large analytical campaign in the United States shows that 70% of legal CBD products in free circulation in the US are contaminated with nearly 300 hazardous chemicals. The results also demonstrate that individual manufacturers of CBD products use fraudulent labeling. This is a legal vacuum that serves the extremely profitable business sector, which in 2020 is estimated at several billion dollars.

Marketing move or fraud

The purpose of the study was to test 240 products, among the best-selling products in the United States outside the pharmaceutical context, whose manufacturers position that they include cannabidiol, regardless of whether they are available on the Internet or in retail stores. In addition, the task was to determine the real amount of cannabidiol in the above products. The results are depressing: they demonstrate that about half of the labels are false and that dozens of certified CBD products do not contain at all or contain a trace amount of any non-drug cannabinoids. Another discovery, even more alarming: manufacturers of cannabinoid products mostly use raw materials contaminated with heavy metals and pesticides.

The analysis shows that 70% of CBD products tested are extremely contaminated and do not meet the minimum requirements of current US legislation. Some products, for example, contain lead levels that are almost 100 times higher than the threshold defined by US regulations. 

The quality of cannabidiol-containing hemp products raises huge questions

U.S. federal law, which is very vague regarding CBD products, states that any product is legal if it was obtained from industrial hemp and contains less than 0.3% tetrahydrocannabinol. However, the cultivation of industrial crops of technical hemp is allowed in the United States only since December 2018. Until 2019, a significant amount of hemp was imported from China. It should be noted that in a huge number of cases in China, hemp is used as a phytoremedient, since the plant has excellent phytosanitary qualities and at the same time, its cultivation is extremely profitable. This can explain the presence of arsenic, lead, glyphosates and other poisons for the human body in individual samples of cannabinoid oils sold everywhere in the United States.

Vague legal framework that brings superprofits 

The main players in the American market for CBD products point out the numerous shortcomings of the legislative tools regulating the production and marketing of cannabidiol. For example, since CBD is not included in the list of substances prohibited by federal law, no producer of CBD extracts or CBD products is required to control the exact amount of the above drug-free cannabinoid in the manufactured product, in contrast to the content of tetrahydrocannabinol, which is subject to strict control. As a result, individual consumers have health problems provoked precisely by the use of CBD products (in the United States, individual cases of cannabidiol poisoning were already recorded before the vaping scandal). Large retailers, together with public organizations, require US government agencies to immediately reorganize the market, review the legal framework, on the one hand, and create clear and transparent tools for cultivating, processing and selling raw materials and high-quality CBD products on the other. Among other things, the question is raised of the need to establish strict standards of production, quality control and packaging.

After reading the above information, a huge number of questions immediately arise, in particular:

- what quality CBD products are sold on the territory of Ukraine, if there is no control whatsoever in our country for such products sold on the Internet;

- why the public of our country does not raise the question of the need to use absolutely socially safe leaves and inflorescences of technical hemp of a therapeutic orientation with a significant healing effect for industrial purposes;

- where will the “Chinese / global CBD consumer goods” pour in when the criteria for the quality of such products are regulated at the level of the regulatory framework in economically developed countries.
