German retailers may face years of jail for selling hemp tea


As recent court cases in Germany show , even the sale of products with little or no THC can lead to hemp retailers having problems with law enforcement.

The prosecutor's office in Braunschweig , Germany , raises the issue of the need to detain several employees of one of the hemp stores working in the city, who until recently sold hemp tea . Employees of the German prosecutor's claim that the sale of hemp tea is illegal no matter how low it is the level of tetrahydrocannabinol (THC). 

During the court hearing , the prosecutors in Braunschweig requested the managers of the Hanfbar retail store , Marcel Kaine and Bardia Hatefi, respectively 3 and 2.5 years in custody. In turn, the leadership of the aforementioned German hemp shop is making excuses by claiming that exactly the same hemp teas are widely available in other places and that such accusations by government agencies are unfair.

Prosecutors argue that hemp tea is banned in accordance with German law on drugs, which states that hemp products cannot be used for intoxicating purposes. According to law enforcement officials, it was discovered that individual companies illegally sell CBD products as food products without the necessary prior marketing authorization required for “new food products ”. However, the Hanfbar case is not related to the problem of interpreting the concept of “new food ”. Instead, prosecutors say hemp teas can be used for intoxicating purposes, violating certain provisions of the Law on Drugs. Two experts spoke in support of the prosecutor’s position during the trial, who argued that even a small amount of THC could cause an intoxicating effect if leaves and inflorescences were smoked in large quantities or used as food . According to the prosecutor’s office, the defendants demonstrated a “flagrant lack of understanding of the illegality of their actions” and turned out to be “completely inadequate” even after several police raids. In addition, according to the prosecution, Hanfbar employees were deceiving their customers that the sale of hemp teas was legal.

During the hearing, the defense side of Marcel Kaine asked the question “What is the logic of prosecutorial actions if they try to prosecute Hanfbar employees, at the same time, other hemp stores that carry out exactly the same activities are not prosecuted? selling absolutely the same tea both in Braunschweig and throughout the country . ”

With regard to food , the Federal Institute for Medicines and Medical Devices (BfArM) follows the instructions of the Federal Institute for Risk Assessment (BfR) in Germany . In turn, BfR is an institute of the Federal Ministry of Food and Agriculture of the country that provides scientific advice on food safety .

The above state structures in Germany have established the following boundary values ​​of THC for food :

• 5 micrograms / kilogram - for drinks;

• 5000 micrograms / kilogram - for oils ;

• 150 micrograms / kilogram for all other foods .

We can talk about “unfair” competition in the German market for hemp grocery retail , which leads to the indictment of illegal activities by individual business entities , while exactly the same activities by larger retailers are “not noticed” by law enforcement officials. As recent court cases in Germany show , even the sale of products with little or no THC can lead to hemp retailers having problems with law enforcement.

I would like to focus on the fact that, in spite of the fact that in Germany the amount of controlled substance in the sold food products , drinks and oils is strictly defined at the legislative level , excesses regularly occur with law enforcement officials of the country. What to say about the Ukrainian market , where there is no such regulatory framework. In fact, any product that contains at least a trace amount of TGCs is outside the scope of current legislation and, if documented by law enforcement agencies, persons selling this kind of product items or buyers who acquire them fall under at least the “corruption sight” of law enforcement officials. Based on the foregoing, as well as the rule that pure natural cannabidiol does not exist in nature (at least a trace amount of THC remains during any extraction) we ask Ukrainian retailers of CBD products - either synthetic cannabidiol products are sold on the shelves of your stores (itself it’s neuro- and cardiotoxic in itself), or do the operatives of which law enforcement structure have your employees “in touch” or “on the counter”?
