114 samples of products containing cannabinoids are listed as hazardous in the EU Warning System

Considering the dominance of the national market by poor-quality cannabinoid products sold mainly at “bargain prices” by companies from economically developed countries, this prevents the development of an effective regulatory framework that provides an opportunity not only to check the products imported to the territory of the country for safety, but also create conditions for the development of appropriate industries using the therapeutic properties of technical hemp of a therapeutic orientation used for industrial purposes (food, cosmetics, biologically active / feed additives, etc.).

The pages of the specialized electronic publication of Ukrainian hemp breeders regularly emphasize the attention of our esteemed readers on various incidents in economically developed countries related to restrictions on the sale of food products, dietary supplements, nutritional and feed additives, which include cannabinoids. The repeated facts of warnings and prohibitions on the distribution of such products were reported in relation to the markets of the USA and Great Britain. Given the proximity of the European market to Ukraine, as well as the great likelihood that prohibited products for distribution in the territory of the European Union are sold in our country, the editorial office turned to specialists of the information and analytical platform Hemp Consulting with a request to comment on the situation in this area, which develops on this moment. In fact, the questions asked by us, the following information was provided by Hemp Consulting experts.

Since the beginning of 2019, the authorities of the EU member states have sent applications for 114 food products, as well as pet products, which include cannabinoids, to the specially created Quick Alert System. Food products that include cannabinoids included in the EU rapid alert system are most often mentioned as containing “unauthorized food ingredient” - 101 precedents. Another 13 cases relate to “unauthorized animal feed additives”.

From January 1, 2019 to the present day, the following countries have submitted proposals to ban the sale of food products and feed additives containing cannabinoids: Germany, Sweden, Spain, Austria, Switzerland, Greece, Denmark, Italy, Lithuania, Poland, Slovenia , Belgium, Finland, Ireland.

The relevant documents aimed at prohibiting the sale of cannabinoid food products in the EU were submitted by countries: Sweden, Germany, Spain, Ireland, Denmark, Austria, Switzerland, Belgium, Lithuania, Finland, Poland, Italy, Greece, Slovenia.

Commentary by the Ukrainian Technical Hemp Association

Rapid Alert System for Food and Feed (RASFF) is a catalog of products warning the EU government about food and animal feed safety issues in the European Union (27 countries). In addition to the EU countries, this warning system includes Norway, Liechtenstein, Iceland, Switzerland. The system is managed by officials of the European Commission. RASFF is a tool for national authorities to quickly share information on the health risks associated with food and animal feed in the EU common market. A RASFF member who identifies a health hazard in a product may use the System to label this product for RASFF members and describe measures that are being taken to eliminate the risk of sales of these products on the market. Possible actions against the marked product - its detention, recall, withdrawal.  

The above information allows us to draw a number of extremely simple conclusions:

- The USA, Great Britain, European countries are actively protecting their market from a number of food products and feed additives for animals, which include cannabinoids. This suggests that at the level of government officials of economically developed countries there is an understanding that not every product containing derivatives of hemp plants is safe;

- given the huge list of products that have been banned for sale in the United States, Great Britain, and also in Europe over the past 1.5 years, the question of whether it can be sold “to stock countries” is not debatable;

- given the absence of any regulatory framework on this topic in Ukraine, as well as established sales systems already carried out using modern means of communication, the basis for the sale of cannabinoid products banned for sale in economically developed countries is based on smuggling schemes for its import into our territory country. The inexperienced Ukrainian consumer, who focuses primarily on the price tag, at the moment does not even think about the fact that the cannabinoid products sold in our country, besides getting into it bypassing the current legislation, can not only benefit, but also have a significant negative impact on human body;

- taking into account the dominance of the national market of poor-quality cannabinoid products sold mainly “at bargain prices” by companies from economically developed countries, which prevents the development of an effective regulatory framework that provides the opportunity not only to check the products imported into the country, but also create conditions for development relevant industries using the therapeutic properties of technical hemp of a therapeutic orientation used for industrial purposes (food, cosmetics, biologically active / feed additives, etc.).
